Witness in Mass. corruption case to be sentenced

October 16, 2011

A former software salesman who testified at the trial that led to the conviction of former Massachusetts House Speaker Salvatore DiMasi faces sentencing this week.

Joseph Lally pleaded guilty and cooperated with federal prosecutors in exchange for a potentially lighter sentence.

Prosecutors are recommending that Lally serve 28 months in prison. Defense attorneys will ask Judge Mark Wolf on Wednesday to give the former Cognos salesman a year behind bars followed by six months of home confinement.

Lally could face more than 10 years under federal sentencing guidelines, but prosecutors say he deserves leniency because his cooperation was “instrumental’’ to the case.

Lally testified about a scheme to use DiMasi’s clout to steer two state contracts to Cognos in exchange for kickbacks.

DiMasi, who is appealing, has been sentenced to eight years in prison.
