A judge disclosed for the first time that the artist known for his Barack Obama “HOPE’’ image is under criminal investigation. A grand jury began an investigation after Shepard Fairey said he erred about which Associated Press photo he used as the basis for “HOPE’’ and had submitted false images and deleted other images to conceal his mistake. The disclosure came during a hearing yesterday regarding Fairey’s request for a six-month delay in the copyright case he brought against the AP. Judge Alvin Hellerstein denied the request, saying a delay would cause the AP irreparable damage, but said that Fairey can refuse to answer questions because of the criminal investigation.

Travolta pilots aid
John Travolta
flew a jetliner carrying relief supplies into the Haitian capital, along with doctors and ministers from the Church of Scientology. The 55-year-old actor piloted his own Boeing 707 from Florida with six tons of ready-to-eat military rations and medical supplies for survivors of Haiti’s earthquake. His wife, Kelly Preston, was also aboard. “We have the ability to actually help make a difference in the situation in Haiti and I just can’t see not using this plane to help,’’ Travolta said.
Martha taking charge
The Hallmark Channel is giving Martha Stewart control over a chunk of its daytime lineup. Stewart’s weekday program, currently syndicated to various broadcast channels across the country, will move to the Hallmark Channel in September, the network and Martha Stewart Living Omnimedia Inc. announced yesterday. Stewart’s production company will be responsible for 90 minutes of additional programming that will air following the first run of her show.
